Last Updated June 18, 2013
These Terms of Service (“Terms”) are a legal agreement between you and griddig, Inc. (“we” or “griddig”). “You” refers to each person or entity that uses the Service.
These Terms are immediately effective upon your use of or access to the Services. The effective date of the Agreement shall be the date listed as the start date for Services on the registration page or order form, and the initial term of this Agreement will be the term stated there, unless terminated earlier in accordance with this Agreement. This Agreement will automatically renew for additional periods equal to the initial term unless either party notifies the other in writing of its intent not to renew at least thirty (30) days prior to expiration of such initial term or the then-current renewal term.
Your Rights To Use The Services
The Services are protected by copyright, trade secret, and other intellectual property laws. griddig and its partners, licensors and suppliers are the owners of all rights in and to the Services except as expressly provided in this Agreement. So long as you meet any applicable payment obligations and comply with this Agreement, griddig grants to you a personal, limited, nonexclusive, nontransferable right to use the Services. If you believe that any Content you posted via the Services that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner or the owner of the intellectual property, the owner’s agent, or pursuant to the law, to post and use such Content, you may send a counter-notice containing the following information to our Copyright Agent: (1) your physical or electronic signature; (2) identification of the Content that has been removed or to which access has been disabled and the location at which the Content appeared before it was removed or disabled; (3) a statement that you have a good faith belief that the Content was removed or disabled as a result of mistake or a misidentification of the Content; (4) adequate information by which we can contact you, including your name, address, telephone number, and e-mail address; and (5) a statement that you will consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
